If BIOS sees it as a HDD then it needs an MBR (e.g. mbr.bin.)

If the BIOS sees it as a FDD then it should not have an MBR.

SYSLINUX only supports FAT12 and FAT16.  You need another boot loader if
you want to boot from ext3 (the semi-mythical "extlinux" hasn't actually
happened yet.)
